Being located in the Northern Atlanta area has provided us with extensive experience in construction litigation. These services range from contract negotiation and drafting through complex construction litigation, arbitration, and dispute resolution. We have been engaged in a wide range from representation of national construction companies to arbitration of home builder claims. We have also been engaged by a number of Atlanta area developers in all legal aspects of project handling. Our expertise involves all aspects of litigation and arbitration, together with contract drafting and negotiation.
This litigation involves disputes over defective construction from the structure, water runoff, construction of the development (sewer lines, road ways, retention areas etc.) to subcontractor issues. Some examples include 1.) a builder being sued for a construction defect and/or code violations, 2) a developer being sued for silt problems or water runoff, 3) the contractor having to bring a lawsuit over defective construction of sewer, water lines, grading, retention areas, and engineering problems, 4) representing engineers that have been sued, 5) litigation over enforcement of contract provisions, 6) litigation against governmental entities for failure to issue permits, etc., and 7) survey, easement and land title disputes. This includes construction arbitration and dealing with local governments on code and zoning issues. -Top- Alternative Dispute Resolution. Davidson, Fuller & Sloan, L.L.P. is fully qualified to engage in representation of clients in various forms of Alternative Dispute Resolution. This involves representation of clients before governmental arbitration panels and mediators as well as private arbitrators and mediators. ADR is a variety of methods used to quickly and more efficiently resolve disputes. It is very common in employment litigation and construction litigation. Generally, these involve arbitration which is similar to a trial in many except no jury is involved. While we at Davidson, Fuller & Sloan, L.L.P. strongly believe in the right to a jury trial, we are well versed and ready to handle any matter in arbitration. ADR also involves mediation which is a process that involves settlement negotiations between the parties and their representatives with a professional mediator.
